IMPORTANT WORKERS COMPENSATION DEADLINES
NOTICE OF INJURY
An injured worker should give notice of his/her injury to the employer
within 30 days after the injury occurs. If this is not accomplished, there
is a rebuttable presumption that the injury is not work related. This time
period is different for repetitive trauma injuries and occupational
diseases.
WORKERS’ COMPENSATION CLAIM
A workers’ compensation claim must be filed within 2 years of the date of
injury or date of last authorized medical treatment or payment of benefits.
Again, the rules regarding the filing of a workers’ compensation claim are
different for diseases and repetitive trauma injuries. The 30-day notice
period discussed above can oftentimes be dealt with and overcome if missed,
but the 2-year period for filing a claim cannot. If the claim is not filed
within 2 years, your employer is “off the hook” and does not have to pay you
any type of workers’ compensation benefits.
You should always request an accident report form from your employer when
you have been injured. Failure to complete this form can be used to deny
benefits that you are entitled to receive.
